Enrollment qualifications

Enrollment is subject to approval by the McConnell Center without regard to race, sex, ethnic background or religion. Any individual 18 years or older of proven financial responsibility is eligible to participate in a membership program. Enrollment includes the participant's right to use the facilities in accordance with these Terms and Conditions, and the McConnell Center 's rules, regulations and policies, which may be amended from time to time. Participant enrollment is non-transferable.

Right to cancellation

You may cancel this agreement without any penalty or further obligation within three business days from your enrollment date or the date the facility is available for your use. Fees associated with the Health and Risk Assessment are not refundable after assessment services are completed.

Notification of cancellation must be made in writing.  Cancellation will become effective on the first day of the following month, providing notice is given on or before the 20th day of the current month.

Fees

The McConnell Center, at its option, may increase fees from time to time. Program participants will be notified at least 30 days prior to any fee increase. If you have paid in advance, your fees will not increase until your renewal date. Fitness program fees are subject to state sales tax.

Payment policies

Participants may pay for their program in full at time of enrollment or renewal, or with monthly installments. The McConnell Center will accept cash, check or major credit card in an amount equal to the full value of the appropriate program.

Participants choosing to pay monthly installments will be required to pay through EFT (Electronic Fund Transfer). Monthly fees are collected in advance of the month that services will be delivered through EFT of checking account or credit card debit.

Automatic payment will continue on a monthly basis at the appropriate rate until you give notice. The notice must be received on or before the 20th of the month or the next calendar month will serve as the final month billed. Participants agree to pay collection costs incurred in collecting any past due amounts.

Participant also agrees to pay a $20 handling fee for any returned check, EFT or credit card.

Health and risk assessment

All program participants complete a Health and Risk Assessment prior to program participation. This service allows staff to evaluate physiological parameters, including current health status and risk factors. This information is used to design each participant's program.

Damages

Participants are responsible for any damages to McConnell Center property and/or property of other participants caused by themselves, except that due to ordinary wear or usage.

Waiver of claims

Any exercise, fitness, therapy or rehabilitation program, or the use of a facility like the McConnell Heart Health Center (the "Center") and its programs and services has inherent with it a risk to you of personal injury or property damage. This may include, without limitation, damages or injuries (even death) that may result from: (I) exercise or exercise induced illness or injuries (whether the exercise is properly or improperly performed); (II) slips and falls, and any other injuries you may sustain on, or as a result of the use of Center facilities, grounds, facility, equipment or service problems or malfunctions); (III) injuries you may sustain as a result of the acts or omissions of other Center participants; or (IV) damages to, or loss or theft of your automobile or its contents, contents stored in lockers, or any other personal property you bring to the Center. The Center will not be responsible for these or any other injuries or damages you may sustain in connection with your use of the Center, or your participation in the services and programs offered there.

As a condition of such use and participation, you agree that use of the Center will be undertaken by you at your sole risk and responsibility, and without any liability to you on the part of the Center, its owners, parent, subsidiary or affiliate organizations, or their respective employees, managers, agents, officers or directors (collectively the "Center Representatives"). You, on behalf of yourself and your executors, administrators, heirs, representatives, assigns and successors, do hereby expressly forever release, hold harmless and discharge the Center and all Center Representative from, all direct or indirect injuries (including death), damages, expenses, costs, claims, demands, or legal or equitable actions or causes of action of any kind, that result from your use of the Center, its facilities, equipment, grounds, supplies, amenities and services, or any transportation provided, including, without limitation, any acts of active or passive negligence on the part of the Center or any Center Representative, or the active or passive negligence or intentional misconduct of other participants at the Center.

Suspension/termination

The McConnell Center may terminate for cause any program agreement by mailing notice in writing to the last address shown on the McConnell Center 's records for the participant. Upon termination, participant will remain liable for all dues and other indebtedness incurred until their anniversary date. Use of the facility is available only to participants in good standing. [A participant in good standing is one who has no outstanding fees due or charges to the McConnell Center over 30 days old, or has no misconduct reports in his or her file.]

Re-enrollment

If you choose to terminate your membership and should decide to return to the McConnell Heart Health Center within one year of the termination, you will be assessed a re-enrollment fee. If you return after one year has passed, you will need to complete the entire enrollment process again and will be assessed the current enrollment fees.

Changes to this agreement

Any changes to this agreement must be in writing and signed by an authorized officer of the McConnell Heart Health Center . Failure to abide by this document may result in termination from the program.

Card/number

Each participant is issued a program card and a number. The participant will present either card or number at the front desk to gain access to the facilities.

Research content

From time to time you may be asked to complete an evaluation questionnaire. By completing the questionnaire, you consent to the use of the information for research purposes on the condition that the date will be coded and information reported anonymously. You are free to refuse or withdraw this consent at any time

Leave of absence

Members may apply for a leave of absence if they are unable to use the McConnell Center for more than 30 consecutive days. Fees will be reduced to the leave of absence fee per month during the leave of absence. No retroactive requests will be granted.

Medical freeze

Members may request a medical freeze for up to six months for an approved major medical illness or surgery. Requests for medical freeze must be requested within 30 days. No retroactive requests will be granted.

Seniors/OhioHealth

Seniors age 65 and older and OhioHealth associates qualify for special rates.

Extended family

Extended family may be added to a primary membership. Extended family includes spouse, adult children ages 18-25 and parents living in the household. Primary membership must remain active for family to continue extended family privileges.
